        (hereinafter referred to as “Ottica Rizzato”, the “Company”, the “Seller”, or the “Owner”).


        1. Purpose and scope of application

        These General Conditions govern the distance sale of products marketed through the website www.otticarizzato.com.

        Access to the website and the placing of an order imply full acceptance of these General Conditions.

        These Conditions apply exclusively to consumers pursuant to Article 3 of Italian Legislative Decree No. 206/2005 (Consumer Code), namely natural persons acting for purposes unrelated to any business, commercial, craft or professional activity carried out.

        Ottica Rizzato reserves the right not to accept orders from persons other than consumers or orders that appear abnormal in quantity or frequency.


        2. Conclusion of the contract

        The display of products on the website constitutes an invitation to offer and not a public offer.

        The contract shall be deemed concluded only when Ottica Rizzato sends the user an express order acceptance confirmation or upon shipment of the goods, whichever occurs first.

        The automatic order receipt confirmation email does not constitute acceptance of the contractual proposal, but only acknowledgment of receipt.

        Ottica Rizzato reserves the unquestionable right to refuse the order even after sending the automatic confirmation in the following non-exhaustive cases:

        • subsequent unavailability of the product;
        • evident and recognizable pricing errors;
        • suspicion of fraud or unlawful use of the website;
        • unverifiable payment details.

        In such cases, any amounts already paid shall be refunded without undue delay.


        3. Prices and product information

        Prices are expressed in Euro (€) and include VAT where applicable.

        Shipping costs or additional charges are indicated separately prior to order completion. Any customs duties are entirely borne by the customer.

        Adding products to the cart does NOT reserve the price.

        In case of an evident and recognizable pricing error, the Seller may cancel the order even after confirmation.

        Product images are for illustrative purposes only. Minor color or aesthetic differences shall not constitute lack of conformity.

        Medical Devices and VAT

        Prescription frames sold without corrective lenses do not qualify as medical devices and are subject to ordinary VAT at 22%, without eligibility for tax deduction.


        4. Product availability

        Product availability is indicative and not guaranteed in real time.

        In the event of subsequent unavailability, the customer shall be informed within 30 days from order submission and may choose between a full refund or replacement with a product of equal value.

        Any obligation to source products from third parties is expressly excluded.


        5. Payments

        The following payment methods are accepted:

        • Credit Card (Visa, Mastercard)
        • PayPal
        • Google Pay
        • Bank transfer (Italy only)

        Payment data are not stored by Ottica Rizzato but are processed through certified secure payment providers.


        6. Shipping and delivery

        Delivery shall be made to the address indicated by the customer within the specified timeframe, except in cases of force majeure.

        Delivery times are indicative and not essential.

        Ottica Rizzato shall not be liable for delays attributable to:

        • couriers
        • customs authorities
        • weather conditions
        • strikes
        • force majeure
        • unforeseen events

        The risk of loss or damage to the goods transfers to the consumer only upon physical delivery of the goods.


        7. Right of withdrawal (EU consumers)

        If you are purchasing as a consumer and your purchase is governed by the consumer protection laws of the European Union or other applicable mandatory consumer protection legislation, you may have the right to withdraw from your purchase. Where the Italian Consumer Code (Legislative Decree No. 206/2005, Articles 52 et seq.) applies, you may exercise your right of withdrawal within 14 (fourteen) calendar days from the date on which you acquires physical possession of the goods, as evidenced by the carrier's proof of delivery.

        How to exercise your right of withdrawal

        Ottica Rizzato provides a dedicated online withdrawal function in accordance with applicable consumer protection laws.

        • If you have created an account and are logged in, you may access the "My Orders" section, view all eligible orders placed within the withdrawal period and select either the entire order or one or more individual products, for which you wish to exercise your right of withdrawal.
        • If you placed your order as a guest, or if you are not logged into your account, you may access the online withdrawal section by entering your Order Number and the e-mail address used when placing the order.

        These details are required solely to identify your purchase and process your withdrawal request. Upon receipt of your request, we will promptly acknowledge receipt on a durable medium (normally by e-mail).

        Returning the goods

        You must return the goods, or hand them over to the carrier for return, within 14 (fourteen) days from the date on which you communicated your decision to withdraw. The direct cost of returning the goods shall be borne by the customer. Returned products should be adequately packaged and returned complete with original packaging, accessories, manuals, certificates of authenticity, protective cases or packaging supplied with the goods.

        You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Ottica Rizzato reserves the right to reduce the amount refunded accordingly. The customer remains responsible for the goods until they are received by Ottica Rizzato.

        Refunds

        Refunds will be processed using the same payment method used for the original transaction. We may withhold reimbursement until we have received the returned goods or until you have supplied satisfactory evidence that the goods have been returned, whichever occurs first. Where applicable under EU consumer legislation, reimbursement will be made within 14 (fourteen) days of receiving the withdrawal notice, subject to the conditions above.

        Exclusions from withdrawal

        To the extent permitted by applicable law, including Article 59 of the Italian Consumer Code where applicable, the right of withdrawal does not apply to:

        • goods made to the consumer's specifications or clearly personalised;
        • prescription lenses, custom-made lenses and other bespoke optical products;
        • customised medical devices;
        • sealed goods which are not suitable for return due to health protection or hygiene reasons once unsealed after delivery;
        • products altered or customised at the customer's request;
        • goods whose authenticity, integrity or market value depends upon original seals or protective packaging that has been opened after delivery, where permitted by law;
        • products ordered on a special-order or pre-order basis exclusively for the customer, where such products fall within a statutory exception to the right of withdrawal.
        • vintage products where the applicable legal requirements for such exclusion are satisfied.

        The availability of a return authorisation or the acceptance of returned goods shall not constitute an acknowledgement that the customer is legally entitled to withdraw from the contract. Ottica Rizzato reserves the right to verify that all statutory conditions for the exercise of the Right of Withdrawal have been satisfied before issuing any refund.

        Non-EU customers

        For customers whose purchases are not subject to mandatory European consumer protection legislation, any statutory cancellation or withdrawal rights shall be governed exclusively by the laws applicable to the contract. Unless mandatory local law provides otherwise, the contractual right of withdrawal described in this section applies only where required by applicable law. Nothing in these Terms shall be interpreted as granting broader cancellation or return rights than those required by applicable mandatory legislation.


        8. Legal guarantee of conformity

        Pursuant to Articles 128–135 of the Consumer Code:

        The Seller is liable for any lack of conformity existing at the time of delivery and occurring within 24 months.

        Excluded from the warranty are:

        • damages due to improper use;
        • accidental damage;
        • normal wear and tear;
        • impacts, scratches, breakage;
        • improper maintenance;
        • unauthorized repairs or alterations.

        The primary remedies are repair or replacement. Contract termination is allowed only in cases provided by law.


        9. Limitation of liability

        Except in cases of wilful misconduct or gross negligence:

        • Ottica Rizzato shall not be liable for indirect damages;
        • shall not be liable for loss of profit;
        • shall not be liable for loss of opportunity;
        • shall not be liable for consequential damages;
        • shall not be liable for improper use of the products;
        • shall not be liable for undisclosed subjective incompatibilities.

        In any event, the Seller’s total liability shall not exceed the amount actually paid by the customer for the disputed order.

        The website is provided “as is”.


        10. Indemnification

        The customer agrees to indemnify and hold harmless Ottica Rizzato from any claim, damage, liability or cost arising from:

        • improper use of the website;
        • breach of these Conditions;
        • unlawful use of purchased products.

        11. Force majeure

        The Seller shall not be liable for failure to perform due to events beyond its reasonable control, including but not limited to:

        • pandemics
        • strikes
        • power outages
        • logistical disruptions
        • cyber-attacks
        • governmental measures

        12. Account suspension

        Ottica Rizzato may suspend or terminate an account without prior notice in case of:

        • fraudulent use;
        • abusive disputes;
        • unjustified chargebacks;
        • breach of these Conditions.

        13. Intellectual property

        All website content is protected by copyright law.

        Any reproduction without written authorization is strictly prohibited.


        14. Gift cards

        Gift cards and/or vouchers purchased on the Website are digital payment instruments that may be redeemed exclusively for the purchase of products available on the Website, subject to the applicable terms and conditions.

        • are valid for 12 months;
        • are not rechargeable;
        • are not convertible into cash;
        • do not accrue interest;
        • are not refundable in case of theft or loss.

        Gift cards are equivalent to cash and the holder is responsible for their safekeeping.

        Where applicable under consumer protection laws (including Directive 2011/83/EU and, where relevant, the Italian Consumer Code), consumers may exercise their right of withdrawal within 14 (fourteen) days from the date of purchase of the gift card, provided that the gift card has not been used, redeemed or applied to any purchase. The right of withdrawal shall be considered excluded to the maximum extent permitted by law where the gift card has been:

        • fully or partially used;
        • redeemedin whole or in part;
        • linked to digital content or services where performance has begun with the consumer’s prior express consent and acknowledgement of the loss of withdrawal rights, where applicable under mandatory law.

        15. Privacy

        Personal data are processed in compliance with EU Regulation 2016/679 (GDPR).

        The Privacy Policy is available on the website.


        16. Dispute resolution

        These Conditions are governed by Italian law.

        For consumers, jurisdiction lies with the court of the consumer’s place of residence or domicile.

        17. Amendments

        Ottica Rizzato reserves the right to amend these Conditions at any time.

        Amendments apply only to orders placed after publication.


        18. Severability clause

        If any provision is deemed invalid, the remaining provisions shall remain fully valid and effective.
